1. Agreement and eligibility
These Terms form an agreement between you and RouteScout ("RouteScout," "we," "us," or "our") when you create an account, purchase a subscription, or use our websites, applications, and related services (the "Service"). You must be at least 18 years old and able to enter a binding contract. If you use the Service for an organization, you represent that you have authority to bind it.
2. The Service
RouteScout provides business discovery, lead and contact organization, route planning, sales activity tracking, follow-up tools, email campaign workflows, product tracking, and reporting. Features may vary by plan and may change as the Service develops. Map listings, hours, routes, contact details, and third-party data may be incomplete or inaccurate; verify important information independently.
3. Accounts and security
You must provide accurate account information, keep credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account and for managing access granted to team members. You may not share an individual login outside your authorized organization.
4. Your data and responsibilities
You retain ownership of information you submit. You grant us a limited license to host, process, transmit, display, and back up that information as necessary to operate, secure, support, and improve the Service. You represent that you have the rights and lawful basis needed to collect, upload, use, and contact each lead. You are solely responsible for your sales practices, messages, route decisions, products, promises, contracts, and compliance with applicable marketing, privacy, consumer-protection, telemarketing, and anti-spam laws.
5. Acceptable use
You must comply with our Acceptable Use and Anti-Spam Policy. You may not use RouteScout for unlawful, deceptive, abusive, infringing, discriminatory, dangerous, or unsolicited activity that violates applicable law or a recipient's opt-out request.
6. Plans, usage allowances, trials, and billing
Plan limits and current prices are shown before purchase. Business-search and expanded-detail allowances reset monthly and are measured separately. Ordinary use of saved CRM records does not count as a new Google business search. We may reasonably change allowances prospectively with notice as third-party pricing or the Service changes. Paid trials require a payment method. Unless canceled before the 14-day trial ends, the selected paid plan begins automatically and Stripe charges the displayed monthly or annual price. Paid subscriptions renew automatically until canceled. Our Subscription and Cancellation Policy and Refund Policy are incorporated into these Terms.
7. Third-party services
The Service may interoperate with Stripe, Google, Microsoft, email providers, mapping providers, and other third parties. Their terms and privacy practices apply to their services. We are not responsible for third-party availability, content, decisions, or changes. You authorize us to exchange the minimum information reasonably necessary to provide an integration you request.
8. Intellectual property and feedback
RouteScout and its software, designs, branding, and documentation are owned by us or our licensors. Except for the limited right to use the Service under these Terms, no rights are transferred. If you provide feedback, you permit us to use it without restriction or compensation.
9. Suspension and termination
You may stop using the Service at any time and may cancel paid service as described in the cancellation policy. We may restrict or suspend access to protect users, third parties, or the Service; investigate suspected violations; comply with law; or address nonpayment. We may terminate for material or repeated violations. Where practical, we will provide notice and a reasonable opportunity to cure.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE SALES RESULTS, LEAD ACCURACY, EMAIL DELIVERY, ROUTE SAFETY, BUSINESS HOURS, OR UNINTERRUPTED OPERATION.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROUTESCOUT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID ROUTESCOUT DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.
12. Indemnification
To the extent permitted by law, you will defend and indemnify RouteScout from third-party claims, damages, and reasonable costs arising from your data, outreach, products or services, violation of law, or breach of these Terms.
13. Governing law and disputes
Virginia law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, each party agrees to send written notice and attempt in good faith to resolve the matter for 30 days. Unless applicable law requires otherwise, state and federal courts serving Westmoreland County, Virginia will have exclusive jurisdiction. Nothing here limits rights that cannot lawfully be waived.
14. Changes and contact
We may update these Terms. Material changes will be announced in the Service, by email, or through another reasonable method and will apply prospectively. Continued use after the effective date means you accept the updated Terms. General questions may be sent to hello@routescoutpro.com. Account-specific or legal notices should be sent to support@routescoutpro.com.
